TUCP party-list protects workers claims on bankrupt business

Workers are the primary social and economic force. However, they are the most vulnerable to the negative impacts of stiff competition and volatile economic conditions. When some enterprises go under, the creditors and government are the first to get their claims against bankrupt businesses.

“This unfair practice must be corrected in favor of workers” said Trade Union Congress Party-list Representative Raymond Democrito C. Mendoza after filing House Bill No. 6959 which calls for workers to be given first lien in case of bankruptcy to satisfy their money claims against the business.

“Dapat unahin ang mga manggagawa na bayaran sapagkat sila ang mas nangangailangan” declared Mendoza.

The bill also states that workers’ unpaid wages and monetary claims shall be paid in full even without formal declaration of bankruptcy or insolvency before claims of the government and other creditors may be paid.

Moreover, Mendoza insisted that when the business is no longer existing and/or unable to satisfy the monetary claims of the worker or workers, the officers shall be held liable for acting on behalf of the business. “Kailangang may hahabulin at mananagot sa mga manggagawa” Mendoza added.

The TUCP Party-List represents the largest organized labor in the country and is aggressively pushing for the full protection of Filipino workers here and abroad.

“The present socio-economic structures are heavily in favor of capitalists and we in the TUCP Party-List will do everything we could to remedy this unjust situation” Mendoza emphasized.
