Nahihirapan ang Department of Labor and Employment (DOLE) makagawa ng ENDO Department Order. Obvious, dahil conflicted pa rin ang DOLE kung ano sila. Nagiisip pa rin sila na sila ay Department of Labor and EmployERS, at inde countervailing institution against the overwhelming power of employers.

TUCP stresses, regardless disinformation ng mga walang ginagawang grupo: (1) TUCP is firmly against contractualization; (2) Mabuti pa wala na lang Department Order, at ipatupad na lang nang maayos ang batas; (3) “[T]he question of whether a person is a labor only contractor [is better] left to the interpretation of the NLRC and the Supreme Court based on the facts of each case brought to their attention in a proper case. What is substantial capital is a judgment of the NLRC and the Supreme Court depending on the facts of the case.” (4)
