Pangangaliwa, maituturing na ‘psychological violence’ – Korte Suprema

MAYNILA – Maituturing na psychological violence laban sa kababaihan ang pagkakaroon ng kabit ng mister, ayon sa ruling na kinatigan ng Supreme Court.

Kinatigan ng Korte Suprema ang ruling ng Regional Trial Court at Court of Appeals sa isang kaso, kung saan itinuturing na psychological violence ang pangangaliwa o marital infidelity na isang paglabag sa Republic Act 9262 o ang Violence Against Women and Children Act of 2004.

Ang nangyari sa kaso, iniwan ng mister ang kaniyang misis para tumira sa Zamboanga kasama ang kabit at nagkaroon pa ng tatlong anak.

Taong 2007 nang makumpirma ng misis na nangangaliwa ang kaniyang mister at kalauna’y nagkaroon ng kasunduan na hindi na ito makikipagkita sa kabit. Pero pagkatapos ng dalawang buwan, bigla na lang umanong umalis ang mister.

Tumawag ang kabit at sinabing may sakit umano ang mister at nanakot pa na papatayin niya ito. Dahil sa nangyari, nakaramdam ng emotional anguish ang misis.

Sa pag-alala, naghain ng Petition for Habeas Corpus ang misis para ma-release ang mister pero nalaman niyang malayang nagsasama ang dalawa, at nalaman pang may tatlo itong anak.

Hinatulan ng 8 taong pagkakakulong ang mister.
