Stiffer penalties for non-payment of 13th month

The Department of Labor and Employment should immediately crack down on employers who failed to give their workers the mandatory 13th-month pay.

Just a day before New Year’s Eve, DOLE’s Labor Communication Office Director Nicon Fameronag told the media that they have received 752 calls from workers nationwide who complained that their employers did not give them their 13th-month pay.

The payment of the 13th-month pay is mandated by law (Presidential Decree No. 851). All employers are supposed to provide their workers 13th-month pay before December 24. Employers may provide half of the 13th-month pay before the opening of the school year but the remaining half must be paid on or before December 24, or they would be liable for administrative sanctions from DOLE.
