Promoters hit manpower

Some 462 former promoters of local manpower agency Temps and Staffers Inc. complained against TSI’s alleged unfair labor practices.

In sworn affidavits, the promoters claim that TSI required them to sign cessation of employment forms before they could receive their last salary, 13-month pay, cash bond and other benefits.

The issue came about when TSI’s contract to provide manpower services with a multinational electronics firm expired last June 30, 2010, to which TSI advised all its promoters that their contracts are co-terminus. In the meantime, they were advised to just wait until TSI can find another project for them but with no assurance of work in the near future.

The promoters said they had no other choice but to sign the form which prohibits them from transferring to the other manpower agencies that will replace TSI. But given the “no work-no pay” policy of TSI, they chose to ignore the stipulations of the cessation of employment and disregarded fear of prosecution by seeking work in other manpower agencies that replaced TSI.

Coincidentally, 13 promoters have also filed a complaint with the National Labor Relations Commission (NLRC) for non-payment of their 13th-month pay and cash bond by TSI because they chose not to sign the cessation of employment form. Resolution of the case is still pending in the NLRC. –Daily Tribune
