THE Regional Tripartite Wages and Productivity Board in Davao Region (RTWPB 11) announces that the new monthly minimum wage rates for domestic workers or the kasambahay in the region will be effective on December 16, 2017 under Wage Order No. RB XI-DW-01. The new minimum wage rates will be as follows: P3,000 for chartered cities and first class municipalities and P2,000 for other municipalities. This is the first Wage Order issued by the RTWPB-XI under Republic Act 10361 also known as the Kasambahay Law.
In accordance with Wage Order No. RB XI-DW-01, an increase of P1,000 is added to the existing wage rate of P2,000 for chartered cities and first class municipalities while an increase of P500 is added to the existing wage rate of P1,500 for other municipalities. The prescribed wage rates under this Wage Order shall apply to all domestic workers, whether in a live-in or live-out arrangement, such as, but not limited to general househelp, yaya, cook, gardener, laundry person, and any person who regularly performs domestic work in one household on an occupational basis.
The following are not covered: service providers, family drivers, children under foster family arrangement, and any other person who performs work occasionally or sporadically and not on an occupational basis. Wage Order No. RB XI-DW-01 will be in full force and effect 15 days after its publication last December 1, 2017 in a newspaper of regional circulation. Under Section 30 (Social and Other Benefits), Article IV of RA 10361, a domestic worker who has rendered at least one month of service shall be covered by the Social Security System (SSS), the Philippine Health Insurance Corporation (Philhealth) and the Home Development Mutual Fund or PAG-IBIG, and shall be entitled to all the benefits in accordance with the pertinent provisions provided by law.
Premium payments or contributions shall be shouldered by the employer; however, if the domestic worker is receiving a wage of P5,000 and above per month, the domestic worker shall pay the proportionate share in the premium payments or contributions, as provided by law.
