No-endo bill na pinasa ng Kongreso, pinuna dahil ‘mahina’

Ikinadismaya ng ilang labor groups ang hindi pagdaan sa bicameral proceedings sa Kongreso ng panukalang security of tenure na layon daw wakasan ang ilegal na kontraktuwalisasyon.

Ito ay matapos kanselahin ang pagtalakay nitong umaga ng Miyerkoles dahil tinanggap na umano ng Kamara ang bersiyon ng Senado ng panukala.

Ikinadismaya ito ni Trade Union Congress of the Philippines party-list Rep. Raymond Mendoza.

“A bit disappointed, yes, on the process, and we could’ve enhanced it from the version in the House,” aniya.

Tingin ng grupong Sentro ng mga Nagkakaisa at Progresibong Manggagawa (SENTRO) na taktika ito ng Kongreso para mailusot ang mahinang bersiyon ng panukala.

“Malinaw na malinaw, niloloko ng Congress ang workers. It will not solve the problem of ‘endo’ (end of contract) at ‘yung pangako ng pangulo ay nakapako pa din,” ani Josua Mata.

Paliwanag niya, ipinagbawal ang “fixed term employment” sa bersiyon ng Kamara maliban na lang kung overseas Filipino worker, on probation, reliever, project-based o seasonal employee ang empleyado.

Sa bersiyon ng Senado, hindi ginamit ang terminong ito at pangamba ng mga labor group na mauuwi ito sa mas komplikadong proseso.

“Alam natin na sa ating batas at sa ating sistema, ‘pag hindi explicit na bawal ang fixed-term employment, malamang mauuwi lang tayo sa mga legal na labanan ulit,” ani Mata.

Bagaman mas tinatanggap naman ng grupong Employer’s Confederation of the Philippines ang bersiyon ng Senado, pinuna ng grupo ang umano’y problema sa depinisyon ng “labor-only contracting” sa panukala.

Ayon sa panukala ng Senado, may labor-only contracting kung:

  • Walang sapat na kapital o investment ang isang job contractor;
    Direktang may kinalaman ang trabaho ng mga manggagawang kanilang sinuplay sa negosyo ng kompanyang pinag-suplayan, o;
    Kontrolado ng kompanya na suplayan ang trabaho ng kanilang manggagawa.

Pangamba ni ECOP President Sergio Ortiz-Luis, maaaring kasuhan at parusahan ang isang kompanyang nakitaan ng kahit isa sa mga senyales ng labor-only contracting – na kinatatakutan umano ng mga foreign investor.

Tingin niya rin, kontraktuwalisasyon ang dahilan kung bakit dumarami ang foreign workers sa bansa gaya ng mga Chinese.

Mas mahal man ang sahod ng mga Chinese laborers, hindi raw kakasuhan ang mga foreign investors na sandali rin lang ang kontrata sa bansa.

Magsusumite naman ang TUCP ng apela sa mga lider ng Senado at Kamara para irekonsidera ang ilan nilang panukala na magpapalakas pa umano sa security of tenure law.–Ulat ni Zen Hernandez, ABS-CBN News
